These Terms of Service ("Terms") govern your access to and use of the TrunkShare mobile and web application, website, and related services (collectively, the "Service") operated by Local Radar LLC, a limited liability company ("Local Radar," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

TrunkShare is a peer-to-peer marketplace that connects individuals who need items delivered ("Senders") with independent drivers who are already traveling along a similar route ("Drivers"). Local Radar is a technology platform. We are not a carrier, freight forwarder, moving company, courier, or logistics provider. Drivers are independent third parties and are not employees, agents, joint venturers, or partners of Local Radar.

2. Eligibility & Accounts

• You must be at least 18 years old and able to form a binding contract.
• You must provide accurate identity, contact, and (if applicable) vehicle and driver-license information.
• You are responsible for all activity under your account and for keeping your credentials secure.
• We may suspend or terminate accounts that violate these Terms or applicable law.

3. Sender Responsibilities

• Accurately describe each item, including size, weight, contents, and value.
• Do not ship Prohibited Items (see our Community & Safety Guidelines).
• Package items appropriately for road transport.
• Ensure someone authorized is available at pickup and drop-off.

4. Driver Responsibilities

• Maintain a valid driver's license, current vehicle registration, and personal auto insurance meeting Washington minimums.
• Follow all traffic laws and safe-driving practices. Do not use the Service while impaired.
• Only accept jobs you are willing and able to complete along your existing route.
• Handle items with reasonable care and complete the Open-Box verification steps in the app.

5. Payments & Escrow

Sender payments are held in escrow by our third-party payment processor and are released to the Driver after delivery is confirmed in-app. TrunkShare charges a service fee disclosed at checkout. All fees are in U.S. dollars. You authorize us and our processor to charge your payment method for the total amount shown.

6. Cancellations, Refunds & Disputes

Cancellation windows, refund eligibility, and the dispute process are described in our Refunds & Cancellations Policy, which is incorporated into these Terms by reference.

7. Prohibited Conduct

You will not: (a) ship illegal, hazardous, perishable-without-cooling, live, or restricted items; (b) circumvent the platform to pay or receive payment off-app; (c) harass, threaten, or defraud other users; (d) scrape, reverse engineer, or interfere with the Service; (e) use the Service for commercial freight, moving companies, or business logistics without our written consent.

8. Insurance & Liability

Drivers are independent contractors and are solely responsible for their vehicles and driving. Local Radar does not provide auto, liability, cargo, or health insurance for users. Personal auto insurance may exclude coverage during for-hire activity — you are responsible for confirming your own coverage. Any item-protection program described in-app is a discretionary reimbursement, not insurance, and is subject to published limits and exclusions.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DRIVERS OR SENDERS WILL MEET YOUR EXPECTATIONS OR THAT DELIVERIES WILL BE TIMELY OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCAL RADAR LLC AND ITS OFFICERS, MEMBERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM, OR (B) US $100.

11. Indemnification

You agree to indemnify and hold harmless Local Radar LLC from any claim, damage, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your content, your interactions with other users, or your violation of these Terms or any law.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Benton County, Washington, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable rights you have as a Washington consumer.

13. Changes

We may update these Terms from time to time. Material changes will be announced in-app or by email at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.
